AnimalSwap, LLC — Terms of Service
Effective Date: October 26, 2026
Last Updated: October 26, 2026
IMPORTANT: THESE TERMS CONTAIN DISCLAIMERS, LIMITATIONS OF LIABILITY, AND RULES FOR RESOLVING DISPUTES. PLEASE READ THEM CAREFULLY.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Member," or "you") and AnimalSwap, LLC, a Texas limited liability company ("AnimalSwap," "Company," "we," "us," or "our").
These Terms govern your use of the AnimalSwap mobile application, websites, and related products and services (collectively, the "Platform").
By creating an account, selecting an acceptance checkbox, or otherwise using the Platform, you agree to comply with these Terms and our Privacy Policy.
If you do not agree, you must not access or use the Platform.
2. Description of the AnimalSwap Platform
AnimalSwap is an online platform intended to connect pet owners interested in arranging reciprocal pet care, pet sitting, or other mutually agreed arrangements.
Members may use the Platform to discover nearby pet owners, communicate, assess compatibility, and coordinate exchanges.
AnimalSwap is a technology platform and does not ordinarily provide pet sitting, boarding, veterinary care, transportation, or other hands-on animal care services.
Unless AnimalSwap expressly agrees otherwise in writing, pet-care arrangements are independently negotiated and performed by the participating members.
AnimalSwap is not an employer, principal, agent, veterinary provider, or insurer of members who provide pet care.
Nothing in these Terms establishes an employment, franchise, partnership, or joint-venture relationship between AnimalSwap and its members.
3. Eligibility and Registration
To create an account, you must:
- Be at least 18 years old and legally capable of entering into a binding agreement.
- Be legally permitted to use the Platform in your jurisdiction.
- Provide accurate account and profile information.
- Maintain the confidentiality and security of your account.
- Comply with applicable federal, state, and local laws.
- Have the legal authority to arrange care for pets you list.
- Maintain only accounts authorized by AnimalSwap.
You agree to update information when it becomes inaccurate or outdated.
You may not impersonate another person or use another individual's account without authorization.
AnimalSwap may deny, restrict, suspend, or terminate accounts when reasonably necessary for safety, security, legal compliance, or enforcement of these Terms.
4. Member Responsibilities
Members are responsible for evaluating whether another member and their environment are suitable for a proposed exchange.
Before accepting an arrangement, members should discuss:
- Pet temperament and compatibility.
- Vaccination and health information.
- Experience caring for the species and breed.
- Feeding, medications, and exercise requirements.
- Emergency veterinary arrangements.
- Authorized pickup and return times.
- Home safety and supervision.
- Other pets, children, and relevant household conditions.
- Any known aggression, escape risks, or medical needs.
Members should independently evaluate potential exchange partners and may choose to conduct a meet-and-greet before exchanging care.
AnimalSwap does not guarantee that a member will provide adequate, safe, or professional pet care.
5. Reciprocal Pet-Care Arrangements
5.1 Nature of Exchanges
An "Exchange" is an arrangement in which members mutually agree to provide or receive pet care, including potentially reciprocal care on different dates.
Members may negotiate the specific details of an Exchange using the communication and scheduling tools made available by AnimalSwap.
An Exchange becomes confirmed only when the participating members affirmatively agree to its terms through the Platform's supported process.
An inquiry, request, or preliminary message does not itself create an obligation to provide care.
5.2 Exchange Conditions
Participating members are responsible for agreeing on:
- The pets involved.
- The services to be provided.
- The start and end dates.
- Care locations.
- Pickup and return arrangements.
- Whether care will be reciprocal.
- Any agreed exchange obligations.
- Emergency procedures.
- Additional conditions applicable to the arrangement.
Members must honor the terms of an accepted Exchange or communicate promptly when performance becomes impossible.
5.3 No Guaranteed Reciprocity
Unless the Platform expressly establishes and enforces a particular exchange-credit or reciprocal obligation, AnimalSwap does not guarantee that one member's provision of care will result in future care from another member.
Members are responsible for understanding and accepting the reciprocal nature, timing, and conditions of their agreements.
5.4 Cancellation
Members should notify the other party as soon as reasonably possible when they cannot complete an accepted Exchange.
Cancellation requirements, penalties, credits, or other remedies will apply only if AnimalSwap has clearly disclosed and implemented the applicable policy.
AnimalSwap does not guarantee replacement pet care following a cancellation.
5.5 Exchange Credits or Points
AnimalSwap may introduce credits, points, or other mechanisms to help coordinate reciprocal pet care.
If implemented, additional terms will describe how credits are earned, redeemed, adjusted, expired, or forfeited.
Unless expressly stated otherwise, such credits will not constitute legal tender, deposits, stored cash value, or property redeemable for money.
No credit or points program is established solely by this provision.
6. Pet Health, Safety, and Legal Requirements
Members must comply with laws concerning animal ownership, licensing, vaccination, leash use, animal welfare, and pet-care activities.
Pet owners represent that they have the authority to arrange care for their pets and have disclosed material medical and behavioral information.
Members providing care agree to exercise reasonable care, follow mutually agreed instructions, provide appropriate supervision, and promptly communicate material safety or health concerns.
Members must not knowingly expose animals to unreasonable dangers.
Animals with a known history of serious aggression, prohibited animals, or animals whose care would violate applicable law must not be offered for an Exchange.
AnimalSwap may establish additional species, breed, size, behavioral, or safety restrictions through published Platform policies.
7. Veterinary Emergencies
Pet owners should supply accurate emergency contact and veterinary information before an Exchange begins.
If a pet becomes injured or ill, the caring member should promptly notify the owner and take reasonable steps appropriate to the circumstances.
If urgent care is needed and the owner cannot be reached, the caring member may seek emergency veterinary assistance consistent with the owner's documented instructions and applicable law.
Unless otherwise expressly agreed, the pet owner remains financially responsible for veterinary expenses incurred for their pet.
This provision does not guarantee that a veterinarian will accept instructions from another member or provide treatment.
Members are encouraged to document emergency-care authorization before an Exchange.
AnimalSwap is not a veterinary clinic or emergency response service and does not guarantee veterinary assistance, reimbursement, or payment.
In emergencies involving people, members should contact appropriate emergency services.
8. Lost, Injured, Abandoned, or Unclaimed Pets
Members must immediately notify the pet owner and appropriate authorities when a pet is missing, has suffered a significant injury, or presents an urgent welfare concern.
A member should not abandon, sell, transfer ownership of, or surrender another person's pet except where permitted by law or reasonably necessary to address an immediate emergency.
If a pet is not retrieved at the agreed time, the caring member should attempt to contact the owner and any identified emergency contact.
Members must comply with applicable animal custody, abandonment, and animal-control laws.
Any reimbursement obligation for additional care or expenses must be supported by applicable law or a valid agreement between the members.
AnimalSwap may provide communication assistance but does not guarantee that it will recover, transport, house, or otherwise take custody of any animal.
9. No Insurance or Guarantee
Unless AnimalSwap expressly introduces a separate written insurance or protection program, use of the Platform does not include:
- Pet insurance.
- Veterinary expense coverage.
- Property damage insurance.
- Personal liability insurance.
- A pet-care reimbursement guarantee.
- Compensation for unsuccessful Exchanges.
- A guarantee of another member's actions.
Members should independently determine whether they have appropriate homeowners, renters, pet, business, or liability insurance for their activities.
Any future protection or reimbursement program will be governed by separate written terms.
10. Member Verification and Background Checks
AnimalSwap may use account verification or safety tools to discourage fraud and improve trust.
AnimalSwap does not represent that all members have completed criminal background checks, identity verification, or professional credential screening.
Unless expressly identified as completed, members should assume that no independent verification of another user's identity, criminal history, competence, or suitability has occurred.
If background screening or verification services are introduced, AnimalSwap will provide additional disclosures and obtain required authorizations.
Verification does not guarantee safety or future behavior.
Members remain responsible for evaluating potential Exchange partners.
11. Prohibited Conduct
Members must not:
- Engage in animal abuse, neglect, cruelty, or unlawful activities.
- Provide false or misleading information.
- Harass, threaten, stalk, or discriminate unlawfully against others.
- Publish another person's private information without authorization.
- Engage in fraud, impersonation, or unauthorized account access.
- Upload malicious software or interfere with Platform operations.
- Attempt to bypass Platform security or access restrictions.
- Use the Platform for spam or unauthorized commercial solicitation.
- Post unlawful, abusive, sexually explicit, or infringing material.
- Misrepresent professional qualifications or safety certifications.
- Use the Platform to arrange unlawful animal breeding, trafficking, or sales.
- Exploit other members financially or attempt to obtain sensitive financial information fraudulently.
- Use automated scraping or bulk collection of member information without authorization.
- Create accounts to evade enforcement actions.
AnimalSwap may remove content, investigate reports, limit functionality, or suspend accounts where appropriate.
Members are encouraged to report suspected safety violations or abusive conduct.
12. User Content
Members may submit profiles, photographs, messages, reviews, pet information, and other materials ("User Content").
Members retain ownership of their User Content.
By submitting User Content, members grant AnimalSwap a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt for technical formatting, and distribute that content as reasonably necessary to operate, maintain, secure, and improve the Platform.
This license does not automatically authorize the use of a member's likeness, private photographs, or other personal information in external advertising without any additional permission legally required.
Members represent that they own or have permission to submit their content and that it does not violate applicable law or third-party rights.
AnimalSwap may remove content that violates these Terms or presents a reasonable safety, legal, or security concern.
13. Ratings and Reviews
If ratings or reviews are supported, they must reflect genuine experiences.
Members must not submit fabricated, retaliatory, manipulated, or otherwise misleading reviews.
AnimalSwap may investigate and remove reviews that violate published policies, applicable law, or these Terms.
AnimalSwap does not guarantee that reviews are accurate, complete, or representative of a member's future behavior.
14. Fees, Payments, and Optional Features
AnimalSwap's central purpose is to facilitate reciprocal pet-care arrangements.
AnimalSwap may offer free or paid features, but no payment obligation arises unless a user affirmatively accepts clearly disclosed charges.
If paid features are introduced, AnimalSwap will disclose the applicable pricing, billing periods, cancellation procedures, renewal terms, and refund conditions before purchase.
Automatic renewal, where offered, will require disclosures, consent, and cancellation mechanisms consistent with applicable law.
Any payment processing will be subject to relevant third-party processor terms.
AnimalSwap does not guarantee payments or reimbursements between members unless explicitly provided under a separate written program.
Members remain responsible for any applicable taxes associated with their independently arranged activities.
15. Privacy and Personal Information
Personal information is handled in accordance with the AnimalSwap Privacy Policy.
Members agree not to misuse personal information obtained through the Platform.
Contact details, home addresses, pet records, and private messages may only be used for legitimate activities associated with the Platform or an agreed Exchange.
Members must not collect, publish, sell, or distribute another member's information without a lawful basis or appropriate permission.
16. Intellectual Property
AnimalSwap owns or licenses the Platform's software, design, branding, graphics, documentation, and other proprietary materials, excluding User Content owned by members.
AnimalSwap grants users a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Platform in accordance with these Terms.
Users may not reproduce, sell, reverse engineer, or commercially exploit proprietary Platform materials except as authorized by law or written permission.
Feedback or suggestions voluntarily provided to AnimalSwap may be used to improve the Platform without compensation, subject to applicable law.
17. Third-Party Services
AnimalSwap may rely on third-party hosting, mapping, authentication, payment, communications, analytics, and other services.
Use of certain features may be subject to additional terms or privacy policies imposed by those providers.
AnimalSwap is not responsible for independent third-party services to the extent permitted by applicable law.
18. Disputes Between Members
Members are independently responsible for their interactions and agreements with other members.
This includes disputes concerning:
- Pet injuries or illnesses.
- Property damage.
- Late or canceled Exchanges.
- Failure to provide reciprocal care.
- Misrepresentations.
- Veterinary expenses.
- Personal injuries.
- Breaches of agreed pet-care instructions.
Members should attempt to resolve disputes directly and in good faith when safe and appropriate.
AnimalSwap may offer reporting or mediation assistance but is not obligated to adjudicate private disputes or compensate either party.
Nothing in these Terms prevents users from contacting law enforcement, animal-control authorities, regulators, or emergency services.
19. Assumption of Risks
Pet care and interactions with unfamiliar people and animals involve inherent risks.
Such risks may include bites, scratches, illness, injury, escape, property damage, theft, personal injury, and veterinary emergencies.
Members acknowledge these risks and agree to exercise reasonable judgment when participating in an Exchange.
To the maximum extent permitted by law, members accept responsibility for their own decisions, conduct, and independently agreed pet-care arrangements.
Nothing in this section excludes responsibility that cannot lawfully be waived.
20. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANIMALSWAP PROVIDES THE PLATFORM ON AN "AS AVAILABLE" BASIS WITHOUT WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR EVERY USER'S NEEDS.
ANIMALSWAP DOES NOT GUARANTEE THE IDENTITY, RELIABILITY, QUALIFICATIONS, BEHAVIOR, OR SUITABILITY OF ANY MEMBER, OR THE SAFETY, QUALITY, OR OUTCOME OF ANY PET-CARE ARRANGEMENT.
THIS DISCLAIMER DOES NOT LIMIT RIGHTS OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANIMALSWAP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF THE PLATFORM, INCLUDING LOST PROFITS, INTERRUPTION OF SERVICES, OR LOSS OF DATA.
TO THE EXTENT LAWFULLY PERMITTED, ANIMALSWAP IS NOT RESPONSIBLE FOR INDEPENDENT ACTS OR OMISSIONS OF MEMBERS, INCLUDING UNSAFE PET CARE, PROPERTY DAMAGE, BREACHES OF PRIVATE EXCHANGE AGREEMENTS, OR MISCONDUCT.
ANY MONETARY CAP ON ANIMALSWAP'S AGGREGATE LIABILITY MUST BE ESTABLISHED IN A SEPARATELY REVIEWED, FINAL VERSION OF THIS SECTION.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, INTENTIONAL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
22. Indemnification
To the extent permitted by applicable law, members agree to indemnify and hold AnimalSwap harmless from third-party claims, liabilities, losses, and reasonable legal expenses arising from:
- Their violation of these Terms.
- Their unlawful conduct.
- Their infringement of third-party rights.
- Their negligent or wrongful conduct involving animals or property.
- Their User Content.
- Their breach of an independently agreed Exchange.
This provision does not require a member to indemnify AnimalSwap for liability caused by AnimalSwap's own unlawful conduct where prohibited by law.
23. Suspension and Termination
Members may discontinue use of the Platform at any time.
AnimalSwap may suspend, restrict, or terminate an account where reasonably necessary to enforce these Terms, respond to safety concerns, prevent fraud, or comply with applicable law.
Users may request account deletion in accordance with the Privacy Policy.
Termination does not extinguish accrued obligations, valid legal claims, or provisions intended to survive termination.
24. Changes to the Platform and Terms
AnimalSwap may modify its features, services, or these Terms from time to time.
Updated Terms will identify their effective date.
Material changes will be communicated as required by applicable law.
Where legally necessary, AnimalSwap will obtain affirmative acceptance of revised Terms.
Changes will not retroactively eliminate rights or obligations where prohibited by law.
25. Governing Law and Dispute Resolution
These Terms are governed by applicable United States federal law and the laws of the State of Texas, without regard to conflict-of-law rules, except where mandatory laws provide otherwise.
Before initiating litigation, parties are encouraged to provide written notice describing the dispute and to attempt good-faith informal resolution.
Subject to applicable law and any subsequently adopted, valid arbitration agreement, disputes that are not resolved informally may be brought before courts with appropriate jurisdiction.
Binding arbitration, class-action waivers, forum selection, and any presuit notice requirements remain subject to legal review and are not established by this draft.
26. General Provisions
If any provision of these Terms is unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Failure to enforce a provision does not constitute a permanent waiver of that provision.
These Terms, the Privacy Policy, and any additional policies validly incorporated by reference constitute the applicable agreement between AnimalSwap and its users regarding use of the Platform.
AnimalSwap may assign these Terms as permitted by law. Users may not transfer their accounts or contractual rights without authorization.
